THIS CONTEST IS GOVERNED BY THE LAWS OF INDIA.
These Official Rules & Regulations (“Official Rules”) describe the terms and conditions for the – Mouser-sponsored IoT Design Contest (“Contest”). The Contest is sponsored by Mouser Electronics Inc., and managed and organised by EFY Enterprises Pvt. Ltd. .(“Contest Managing Partner”).
1.PURPOSE OF THE CONTEST
1.1. The purpose of the Contest is to encourage the techies including the professional design engineers/students/hobbyists/ academia and budding engineers to design and build innovative embedded systems using components provided by Mouser. It is a golden opportunity for audiences including the professional design engineers/students/hobbyists/academia and budding engineers to come out with new ideas and innovations in embedded systems having interesting applications.
2. CONTEST DESCRIPTION/ OVERVIEW
2.1. Participants are challenged to design unique/innovative embedded systems and submit each Entry (“Project”) that must use at least one of the 7 boards or components sponsored by Mouser. In order to be eligible to compete in the Contest, each participant must meet all qualifications set forth in these Official Rules and any related policies. These Official Rules will control over any conflicting provisions in any policies. Sponsored boards or components will be further described below. In the event that participants elect to purchase additional materials, Contest Organiser shall in no way be responsible for reimbursing participants for that or any other costs. The Project must use commercially available components only.
First Prize: Rs 80,000

4. HOW TO ENTER
4.1. All participants must register for this contest at mouser.electronicsforu.com and obtain a Registration ID – Login/Password and then submit Abstracts (defined below) to be considered for the Contest. All Abstracts must be received before 23:59:59 hours IST on 12th of February, 2016. Abstracts received or postmarked after 23:59:59 hours IST on 12th of February, 2016 are ineligible.

4.2. The Abstracts will be reviewed and top 100 Abstracts would be chosen for free components from Mouser. Top 100 will be listed at http://mouser.electronicsforu.com/ on 19th of February, 2016.
4.3. These top 100 Abstracts/projects become eligible to get a free of cost components from Mouser for actual design and development by 4th of March, 2016.
4.4. Using the components provided by Mouser, an Entry (defined below) would be expected from the qualified top 100 participants within the Contest development time i.e. from 4th of March, 2016 to 27th of May, 2016. The term “Entry” refers to the Abstract, Complete Documentation, video of working model and Source Code collectively. To submit an Entry, participants must upload their Project files to their “home page” after using their Login/Passwords.
4.5. To be eligible for Mouser-sponsored IoT Design Contest prizes the participant must submit a complete Entry. Incomplete, illegible, or defaced Entries will be rejected.
4.6. A group of 2 (two) or more participants can enter the Contest by using an independent Registration Form and individual Login/Password for the group Entry. Maximum no of members in a group is restricted to 4 (Four).
4.7. Only one entry is permitted per participant or group and participant/s or group of participants competing through multiple Entries will be disqualified.
4.8. Decision of the Contest Organiser is considered to be final.

4.9. The Contest Organiser reserves all rights to make amendments to the above dates or such other terms and conditions stated herein, without giving prior notice. It shall be the sole responsibility of the participant(s) to check the ‘Official Rules and Regulations’ for the Contest on the official website [http://mouser.electronicsforu.com/] from time to time. The Contest Organiser also reserves the right to cancel and/or postpone the Contest without any prior intimation to the participant(s). The Contest Organiser may at its sole discretion extend or curtail the aforesaid Contest period or may suspend or abandon the same at any time and the participant shall have no objection to the same whatsoever, nor shall the participant make any claims /disputes in respect of the same. It is clarified that no charge shall be made to participate in the Contest.
4.10. Each Project entered in the Contest must be the original work and sole and exclusive property of the person or team who submits it or the participant must have written legal permission from the property owner. In the case of Projects owned in whole or in part by parties other than the participant, the property owner’s written legal permission must be included with the Entry. Entries should be submitted in digital format and must be written in English. Entries (complete documentation as described above) can be submitted by uploading the ZIP file using their login or burnt in a CD/DVD which needs to reach the Contest Managing Partner (EFY Enterprises Pvt. Ltd., New Delhi) on or before the last day of submission. Please note Contest organizer or managing partner are not responsible for any delay or damage in courier/mailing of the CD/DVD.

4.11. For an Entry to be deemed acceptable the participant must first submit a completed Registration Form to receive a Project Registration ID-Login/Password. Proof of transmission of an Entry to the Contest Managing Partner will not constitute proof of receipt of said Entry. To avoid additional shipping and organizational difficulties, copies of submitted Projects will not be returned.
4.12. The Contest Managing Partner and the Contest Organiser assumes no responsibility for lost, late or misdirected entries. Proof of transmission of an Entry to the Contest Managing Partner will not constitute proof of receipt of said Entry.
5. REGISTRATION FORM
5.1. Registration for this Contest is mandatory. All participants must receive a Registration ID – Login/Password for their Abstract/Project. A confirmation email will be sent with an assigned Project Registration ID. This Registration ID is used to identify the specific Abstract/ Project being submitted and must be included on/attached to all Entry documentation and to any correspondence. Only the assigned Registration ID should be used as an ID for the Project.
6. COMPLETE DOCUMENTATION FOR TOP 100 ENTRIES
6.1. The participant must include everything from the Abstract to all other relevant flowcharts, photographs, videos, tables, graphs, etc. The text description should be more extensive than what the participant included in the Abstract. The Complete Documentation should fully explain the development process and function of the Project. Each participant’s Complete Documentation must include:
a) Project Registration ID at the top of the first page or in a header/footer; b) Abstract and Source Code; c) A detailed text description of the participant’s Project and its operation (no page limit); d) At least one photograph of the complete assembly of the participant’s Project; e) At least one block diagram; f) Complete schematic(s) (Note: If a participant uses a demonstration/development board, then the schematic must show the connections to the board and any circuitry added by the participant); g) Any additional photographs, videos, diagrams, screen shots, tables, flowcharts, etc.; h) Do NOT put the participant’s name on any materials. Participants who leave their names in headers, footers, table of contents pages, schematics, etc. may be disqualified. Unique ‘Registration ID’ and Project name will completely identify the Project work.
6.2. It is clarified that in the event the Contest Managing Partner does not receive the 100 Abstracts between 22nd December 2015 and 8th February 2016, the Contest Organizer reserves the right to make alterations to the number of Abstracts to whom components from Mouser will be sent free of cost for each Abstract.
7. ABSTRACT AND PROJECT SUBMISSION GUIDELINES
7.1. The Abstract is a publishable synopsis of the Project (approx. 500 words).
a) Acceptable formats for Abstracts: ASCII, text…we expect atleast a rough block diagram with proposed technology for implementation and components.
b) Acceptable formats for graphics/other files are:

7.2. After the participant receives a Registration ID – Login/ Password they are free to submit an Abstract. All Entries will be reviewed by the Technical Team of the Contest Managing Partner. Once the Abstract qualifies for the Contest, the top 100 participants or team of individuals will receive selected components from Mouser for each Project. All the Projects submitted must be in complete documentation for an Entry to be deemed acceptable.
8. COMPONENT SELECTION
8.1. There will be negative marking for entries wherein chosen components are not used in the final project submission to encourage participants to choose wisely.
9. PARTICIPATION CRITERIA
a) Any individual or group of individuals residing in India may enter the Contest.
b) All the participant must be 18 years and above at the time of registration.
c) Contestants must participate as individuals or groups of individuals, not as corporations, limited liability companies, or other entities.
d) The Contest is void where prohibited or restricted by law.
e) Officers, directors, and employees of Contest Organiser or its affiliates, or any third party company participating in the administration or judging of the Contest or contributing prizes to the Contest (“Partners”), their respective parents, subsidiaries, or affiliates, and their respective advertising, promotion, and production agencies or other agents, as well as members of their immediate families (including spouse, parents, siblings, grandparents, grandchildren, step-children, step-parents and in-laws) or those with whom they reside, are ineligible to enter the Contest.
f) Officers, directors, and employees of the Contest Managing Partner or its affiliates, or any third party company participating in the administration or judging of the Contest or contributing prizes to the Contest, their respective parents, subsidiaries, or affiliates, and their respective advertising, promotion, and production agencies or other agents, as well as members of their immediate families (including spouse, parents, siblings, grandparents, grandchildren, step-children, step-parents and in-laws) or those with whom they reside, are ineligible to enter the Contest. Any other person professionally connected or associated with the Contest is ineligible to participate in the contest.
g) Anyone who is a resident of a country, province or state where the Contest is prohibited, taxed, subject to registration or bonding, subject to disclosure requirements (including without limitation requirements that these Official Rules or other Contest materials be published in a language other than English) or otherwise restricted under national, provincial, state or local statutes, rules, orders, regulations, or other laws, is ineligible to enter the Contest.
h) Contest Organiser expressly disclaims any responsibility or liability for any Contestant who enters in violation of these Official Rules or any Policies. By entering this Contest, each Contestant agrees to waive any additional rights granted with respect to contests by the country, state, or province in which he or she is domiciled.
CONTEST ORGANISER RESERVES THE RIGHT TO REJECT OR DISQUALIFY ANY PERSON IF, IN THE SOLE AND ABSOLUTE DISCRETION OF CONTEST ORGANISER, (I) THE PERSON’S PARTICIPATION IN THE CONTEST IS OR MAY BE PROHIBITED OR OTHERWISE RESTRICTED BY APPLICABLE LAW, OR (II) THE PERSON FAILS TO COMPLY WITH THESE OFFICIAL RULES, ANY POLICIES, OR ANY LAWS IN ANY RESPECT; OR (III) THE PERSON TAMPERS WITH THE ENTRY PROCESS, THE OPERATION OF THE CONTEST, THE CONTEST WEBSITE, OR OTHERWISE ACTS IN AN UNSPORTING \OR DISRUPTIVE MANNER OR WITH INTENT TO ANNOY OR HARASS ANY PERSON. CONTEST ORGANISER RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. IF AN ENTRY THAT WOULD HAVE OTHERWISE RECEIVED A PRIZE OR COMPONENT IS REJECTED OR DISQUALIFIED, CONTEST ORGANISER MAY, BUT IS NOT REQUIRED TO, SELECT AN ALTERNATE WINNING ENTRY FROM THE REMAINING ENTRIES.
By participating in the Contest, it is construed that the participant(s)/winner(s) has read and understood these the General Rules stated below and has agreed to abide by the same.
10. TECHNICAL SUPPORT FOR COMPLETING PROJECTS
10.1. Qualified participants are encouraged to register on the Electronics Talk Forum for support.
11. INTELLECTUAL PROPERTY RIGHTS
11.1. The design and Project remain the intellectual property of the participant. All participants who submit an Entry in the Contest agree to sign a separate agreement granting the Contest Organiser non-exclusive, assignable, full-publication rights of the Contest if they win. The Project submitted remains the property of the participant; however, winning participants agree to sign a separate agreement providing the Contest Organiser a non-exclusive, assignable, right to copy, reproduce, display, publish, and disseminate the Project in any media, without any territorial limitation, as part of any winning Project presentation and to assign all rights, title and interest in the Project to the Contest Organiser. Prior publication or the prior internet posting of essential components in an Entry are not grounds for disqualification.
12. HOW TO WIN THE CONTEST
12.1. Judging shall mean judging for Mouser-sponsored IoT Design Contest prizes. In case an Entry consists of a team of individuals, the prize would be awarded to the team leader. The Entries will be judged equally on energy efficiency and design optimization, technical merit, originality, usefulness, and cost-effectiveness of the project.
13. JUDGING FOR CONTEST SPONSOR PRIZE
13.1. All Entries will be judged by a panel of judges selected and assigned by the Contest Organiser. Each Entry shall be scored based on the criteria listed below.
–a. Originality – The design has concepts or ideas which have either never been done before or makes use of existing concepts and improves upon them using the capabilities of provided components.
b. Application – The application areas of the design.
c. Technical Merit – The design uses many of the capabilities of the provided components, supporting hardware and software to their highest value.
–d. Design Optimization – The design helps to save energy, has been developed as a low-power application, or will help to improve the planet.
– e. Cost Effectiveness – The design maximizes the use of provided components, and requires a minimum of external devices and/or support electronics.
– f. Usefulness – The design is practical and useful in some form of product or demonstration of technology.
13.2. In the event of a tie, the Entry which the judges determine has the most unique Project design will be the winner. In the event of a further tie, the Entry with the highest score in technical merit will be selected.
13.3. Contest judges have been chosen based on their familiarity with engineering design, Contest Organiser component knowledge, and experience. Participants agree to abide by all decisions of the Contest Organiser, which shall be final and binding with respect to all issues relating to the Contest.
14. THE GRAND FINALE
14 The Grand Finale – To be announced by July 2016.
15. RIGHTS IN MATERIALS RELEASE
15.1. By completing the Registration Form, receiving a Registration ID and submitting an Abstract and then an Entry if qualified, each participant certifies that the Project entered in the Contest is their work, or that they have written legal permission from the property owner. Furthermore, they have read and understand the complete rules of the Contest and agree to abide by them.
15.2. By entering the Contest, each participant releases and holds harmless Contest Organiser, the Contest Managing Partner, Partners, any other entities involved in the administration of the Contest, each of their respective parents, subsidiaries, and affiliates, and each of their respective directors, officers, employees, and agents (collectively, the “Organising Parties”), from any and all direct or indirect responsibility, damages, lost profits (including without limitation direct, indirect, incidental, consequential, punitive, and statutory damages), penalties, costs, liabilities, losses, claims, judgements and awards (shall be limited to actual out-of-pocket costs incurred) of any kind arising out of or relating to:
(i) participation in the Contest; (ii) any violation by the participant of these Official Rules, any policies, or any laws; (iii) any copyright, trademark, patent, trade secret, right of publicity, or other intellectual property misappropriation or infringement attributable to participant, his, her or their Entry, or any other Contest materials submitted by participant; (iv) the acceptance, possession, receipt, or use of any prizes or components, or any item purchased with any prizes, awarded or provided by Contest Organiser or any of the Partners ; (v) any problems (including but not limited to errors, omissions, interruptions, defects, or delays in operation or transmission) of any computer, telephone, modem, cable, satellite, network, hardware, online system, server, software, or other equipment or provider); (vi) any internet traffic congestion or website accessibility issues; (vii) delays, cancellations, or other problems with travel or accommodations resulting from any carriers, hotels, travel agents, weather, fires, strikes, bankruptcies, governmental actions, wars, terrorism, or any other causes beyond the reasonable control of Contest Organiser or the Partners; (viii) printing or typographical errors in any Contest related materials; (ix) any other technical or human error that may occur in connection with the Contest; or (x) arising in any way whether in contract, tort (including negligence) or otherwise (the “Causes”). Without limiting the foregoing, Contest Organiser and Partners are not responsible for any injury or damage to participants or any other person’s computer related to, or resulting from participation in, or downloading any material in connection with, the Contest. If anyone makes any claim against Contest Organiser or any Partners arising out of or relating to any of the Causes attributable to a participant, such participant will pay for any damages, penalties, costs, liabilities, and losses, including without limitation attorneys’ and experts’ fees and costs, incurred by Contest Organiser or any such Partners in connection with such claim.
16. ACCEPTANCE OF PRIZES
16.1. All monetary amounts in these Official Rules are indicated in INR (Indian Rupees). ALL POTENTIAL CONTEST WINNERS ARE SUBJECT TO VERIFICATION BY CONTEST ORGANISER/Contest Managing Partner, AS CONTEST ORGANISER, WHO’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. Potential winners must continue to comply with all terms and conditions of these Official Rules. Winning the Contest is contingent upon participant fulfilling all requirements.
16.2. All taxes, fees, duties, levies, withholdings, insurance, shipping, and other charges imposed by third parties, including but not limited to national, state, provincial, and local income or VAT taxes, applicable to any prizes, Entries, Contest materials, or travel awarded or provided by Contest Organiser or otherwise arising out of the Contest are the sole responsibility of the applicable participant.
16.3. Each participant receiving any prizes may be required to provide the Contest Organiser or Partner(s) with his or her taxpayer identification number for tax purposes. Participants must take possession of any prizes or materials in the manner directed by Contest Organiser or Partner(s), as applicable. Only the winner(s) will be notified by the Contest Organiser by way of an email and/or phone calls only, as per the contact information available on his/her Registration Form and /or as may be provided during the process of logging in. The winner(s) shall furnish his/her information including postal address as sought by the Contest Organiser. Failure to respond to any notification by Contest Organiser or a Partner that a participant is eligible to win a prize, or failure to provide any information or documents requested by Contest Organiser or a Partner in the time frame specified by Contest Organiser or a Partner may result in disqualification and possible selection of alternate winners.
16.4. To the extent permitted by law, each participant may be required to sign and return a declaration of eligibility and release of liability upon request by Contest Organiser or a Partner. Each participant will provide the declaration and release within 7 (seven) days of Contest Organiser’ or the Partner’s request for such declaration and release. The declaration and release may include the participant’s confirmation of permission (without further compensation) to use the participant’s Entry, name, photograph, voice, likeness, logo (if any), state of residence, biographical material, for advertising, promotion, and marketing purposes, and for administration of the Contest, including but not limited to mention on Contest Organiser’ or Partners’ websites, and to the exploitation of the participant’s Entry and other Contest materials for any purpose.
CONTEST ORGANISER AND PARTNERS DO NOT MAKE, AND EXPRESSLY DISCLAIM, ANY WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, REGARDING ANY PRIZES, COMPONENTS, TRAVEL, OR ACCOMMODATIONS, INCLUDING WITHOUT LIMITATION ANY IMPLIED OR STATUTORY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. CONTEST ORGANISER AND PARTNERS DISCLAIM ALL INDEMNITIES.
17. DATA PRIVACY
17.1. By accepting Mouser-sponsored IoT Design Contest prize, the Participants consent to the use of their name, photograph and/or likeness, address, voice, and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast, and Internet), for all legitimate business purposes including advertising and promotional activities without additional compensation, unless prohibited by law. The Contest Managing Partner and the Contest Organiser are not responsible for incorrect or inaccurate entry of information including, but not limited to, technical malfunctions, human error, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, Entry materials that have been tampered with, or e-mail or mail-in Entries that are illegible, late, lost, damaged, postage due, or misdirected. The Contest Managing Partner and the Contest Organiser are not responsible for any injury or damage to the participant’s or any other person’s computer related to or resulting from participation or downloading any material in this Contest. Entries that have been tampered with or altered are void.
17.2. The Contest Organiser reserves the right to cancel, terminate, modify, or suspend this Contest in its sole and absolute discretion if it becomes technically corrupted or if for any reason the internet portion of the program is not capable of running as planned, including but not limited to, as a result of infections by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Contest Organiser or the Contest Managing Partner that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest promotion. In such event, Contest Organiser will post notice at the Contest website and will implement an alternate means for awarding all prizes.
18. ENGLISH LANGUAGE ONLY
18.1. These Official Rules, all Contest materials, and all other Contest related documents are and will be in the English language only, and all proceedings relating to the Contest will be conducted in the English language only. Each participant hereby confirms his or her express wish that these documents be written in, and these proceedings be conducted in, the English language.
19. GENERAL RULES
19.1. In the event of any fault, misunderstanding or dispute concerning any part of the Contest the decision of the Contest Organizer shall be final.
19.2. 19.2. The entry process is strictly open to participant (s) residing in India during the period of the Contest and of the age of 18 (eighteen) years and above only. The participant (s) should not have criminal conviction or an arrangement or a contract that prevents the participant(s) from participating in the Contest.
19.3. By virtue of participation, the participant represents and warrants:
a) such individual is, or group of individuals are, domiciled in a country that does not prohibit their Entry into this Contest or winning of the Contest;
b) the individual identified on the Contest registration form is the participant or part of the group that is the participant;
c) the individual and the Entry fully comply with all eligibility requirements and all other provisions of these Official Rules and any related policies;
d) in preparing the Entry and entering and participating in the Contest, the individual has complied and will comply in all respects with all applicable statutes, regulations, rules, orders, or other laws and has not violated, and will not violate, any agreement or understanding by which it is bound, including any confidentiality, employment, consulting, intellectual property assignment or license agreement;
e) the Entry is unpublished and consists entirely of the individual’s or group’s own original work or of work to which such individual or group has all necessary rights;
f) neither the Entry nor the exploitation of the Entry as provided herein will infringe or misappropriate any intellectual property, rights of publicity, or other proprietary rights of any person or entity; and
g) that the participant is not bound by any intellectual property agreement or any other agreement or obligation, with an employer, university, college, educational organization, or otherwise, that prohibits or limits in any way: the participant’s right to participate in the Contest and/or the participant’s right to submit material for the Contest, or that may limit the Contest Organiser’s and the Contest Managing Partner’s rights in any way to such submission in the event the Entry is chosen as a winner.
19.4. The winner(s) represents and undertakes to execute and produce such further documents as may be required by the Contest Organiser in relation to availing the prizes herein.
19.5. The winner(s) agrees to maintain complete confidentiality regarding their selection for the prize any matter relating thereto and shall not disclose any information pertaining to the prize or the Contest which is disclosed to any of the winner and which is not available to public in general, to any person or media etc. without the consent of the Contest Organiser. In case the winner(s) breaches this condition, he/she shall be liable to be disqualification/rejection and shall not be eligible for the prize.
19.6. The prize cannot be transferred, negotiated or exchanged etc. For the sake of clarity, there shall be no other gratification. It is clarified that it is not necessary that the act of collection of the prize will be recorded by the Contest Organiser or will be incorporated in the Contest or find mention in the Contest.
19.7. The Contest Organizer shall not be responsible to pay for any cost, expenses, taxes, duties, charges, license fees, insurance and/or levies applicable under the laws of India, in relation to the prize and the same, and if applicable, winner(s) agrees that the same shall be solely borne by the winner(s).
19.8. The Contest Organizer shall not be responsible for any Entries submitted but not received due to any reason whatsoever including technical disruption and/or failure and/or any other difficulties of such nature.
19.9. At the request of the Contest Organizer, the winner(s) of the Contest agrees that he/she shall co-operate with the Contest Organizer and participate in any activity and/or campaign to the extent that can be reasonably expected of them (“Promotional Activity”). For cooperating with these Promotional Activity no financial compensation will be payable to the winner(s) by the Contest Organizer. The winner(s) agrees that the footage of any nature with regard to the winner(s) from such Promotional Activity and any recording thereof shall vest with the Contest Organizer, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity and the Contest Organizer may exploit the same in any manner and in any media whatsoever at any time throughout the world.
19.10. The participant/winner shall not do any act either directly or indirectly during such Promotional Activity which may bring the Contest Organizer into public disrepute or denigrate any of the preceding, or offend any community or public morals and in all public appearances the participant/winner shall use her/his judgment in general demeanor and choice of language to create an atmosphere which would be conducive to promotion of the Contest.
19.11. All and any incidental costs direct and/or indirect, in relation to the prize, shall be borne by the winner and in no manner whatsoever shall the Contest Organizer, be responsible or liable for the same. For the sake of clarity, the Contest Organizer shall not be responsible to pay for any taxes, duties, charges, license fees, insurance and/or levies applicable under the laws of India, in relation to the prize and the same, if applicable, shall be solely borne by the winner(s).
19.12. The Contest Organiser is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any physical injury, death, mental and/or emotional trauma caused to the participant(s)/winner(s) in any manner whatsoever, in relation to the Contest.
19.13. Each participant in consideration of being given opportunity to participate in the Contest, agrees to hold harmless and indemnify the Contest Organiser, its affiliates, its group companies, their employees, officers, directors and/or any other person from and against any suit/litigation/injury/damage/harm/loss suffered by the Contest Organiser in connection with any act of the participant(s)/participant(s) Entry including any third party rights claims, intellectual property claim, proprietary claim, etc., with respect to the Entry submitted by the participant(s).
19.14. The winner(s) and /or participant(s) shall not in any circumstances make any claims against the Contest Organiser entities arising out of or relating to any and all costs, injuries, losses or damages of any kind, including, without limitation due to any technical faults or directly or indirectly, to the participant(s)/winner’s participation or non-participation in the Contest or any related activity. If the participant/winner is found to be ineligible, or if he or she has not complied with any of these terms, the corresponding Entries will be disqualified.
19.15. Each participant(s)/winner(s) hereby acknowledges and agrees that the relationship between the participant(s)/winner(s) and the Contest Organiser and its/their affiliated companies is not a confidential, fiduciary, or other special relationship.
19.16. Contest Organiser reserves the right to disqualify any participant(s)/winner(s) from participating in the Contest if his/her conduct is found to not be in concurrence with the Official Rules set out herein or as may be revised by Contest Organiser from time to time. Contest Organiser reserves the absolute right and discretion to reject any “Entry” or any part thereof at any stage of the Contest, including after declaring the winner, if Contest Organiser:
a) receives any notice or complaint relating to the Entry not being compliant of the Official Rules including alleged to be infringing any form of rights including rights in any form of intellectual property of any third party;
b) determines at its sole discretion that the Entry is inter alia, belongs to another person and to which the user does not have any right to; blasphemous, indecent, immoral, abusive, offensive, against the applicable laws or libellous and/or is contrary to any law in force; is grossly harmful, harassing, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; harm minors in any way; infringes any patent, trademark, copyright or other proprietary rights; violates any law for the time being in force; deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature; impersonate another person; contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.
19.17. The participant(s)/winner(s) acknowledges that in case the performance of this Contest and/or availing the prize cannot be fulfilled due to war, industrial action, flood or any act of God then such non-performance or failure shall not be deemed as a breach of these Officials Rules and if such inability to perform such obligation continues for a period of 15 (fifteen) days, then the Contest Organiser shall be at liberty and upon their sole discretion to terminate any such gratification and/or participation of a participant(s)/winner(s) forthwith and such decision shall be final and binding.
19.18. Participant(s)/winner(s) acknowledges that in case any portion/clause of these Officials Rules is deemed invalid or becomes unenforceable or prohibited by the law of the country, such portions shall be considered divisible and shall not be part of the consideration, and the remainder of these Officials Rules shall be valid and binding and of like effect as though such provision was not included herein.
19.19. Participant(s)/winner(s) acknowledges that participant(s)/winner’s representations, warranties, indemnities, grant of rights in the Entry, dispute mechanism and obligations shall survive the efflux of time and the termination of these Officials Rules.
19.20. By participating in the Contest, each participant(s)/winner (s) acknowledges and agrees that any and all disputes, claims and causes of action arising out of or in connection with the Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action.
19.21. The participants/winner(s) shall at all times comply with the applicable laws, rules and regulations of India including the terms and conditions of the website on which this Contest is promoted and viewed.
19.22. These Official Rules shall be construed in accordance with the laws of India and in case of any dispute or other matter arising in reference to the prize and/or the Contest shall be referred to a sole arbitrator appointed by Contest Organiser and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Bangalore, India and shall be conducted in English language. All the costs, charges and expenses in connection to the arbitration shall be solely borne by the participant/winner who has raised the dispute.
19.23. Subject to the above provision, the Courts having jurisdiction under the provisions of the Arbitration and Conciliation Act, 1996, to determine all matters which the Court is entitled to determine under the Act, including, without limitation, provision of interim relief’s under the provisions of Section 9 of the Arbitration and Conciliation Act, 1996, shall exclusively be the courts at New Delhi, India.
